Definations

  • BA Car Hire (“BACH”) the Private Hire Vehicle Operator (“PHVO”) licensed by Transport for London (“TfL”), Licence number [APPLIED FOR], provides services under the Private Hire Vehicles (London) (Operators’ Licences) Regulations 2000.
  • Passenger (“You/Your”) refers to the individual or corporate entity making the booking for carriage and entering into a contract with BA Car Hire.
  • Transportation Services (“TS”) refers to the provision of the journey as requested by the Passenger.
  • Agent (“Agent”) refers to a third party making the booking on Your behalf.

1. General Conditions for Accepting Transportation Services

1.1. BA Car Hire is responsible for accepting the booking as well as providing the TS.

1.2. By accepting a booking, BA Car Hire confirms that a contract has been established between BA Car Hire and You for the provision of TS.

1.3. BA Car Hire confirms that fares for the journey are collected either by BA Car Hire or the driver on behalf of BA Car Hire, even when the driver acts as an agent for BA Car Hire in collecting fares.

1.4. Only BA Car Hire, as the operator, has the authority to cancel a booking with a passenger, although a driver may reject a particular journey offered by the operator.

1.5. BA Car Hire confirms that liability in relation to the TS lies with the operator, namely BA Car Hire, and cannot be delegated to any third party.

2. Service Level

The TS offered to You will be a reliable and cost-effective service through a range of vehicles selected by you. BA Car Hire aims to provide a seamless experience from pick-up to drop-off.

3. Transfer Rides/Hourly Bookings and Changes to Service

3.1. You may choose between transfer rides and hourly bookings for your TS. If additional effort is required compared to the original booking, BA Car Hire will endeavor to accommodate this, which may result in additional costs. These will be explained by BA Car Hire or its driver before incurring any additional charges. Changes are subject to availability and may be made even after the contract is finalized, subject to agreed price amendments.

3.2. For transfer services, the quoted price is valid for a specified start and destination address. BA Car Hire may charge additional fees for any stopovers or deviations from the agreed route requested by You. 3.3. For hourly bookings, the trip must end in the area of the pick-up location unless otherwise agreed by BA Car Hire.

4. Vehicle Class/Vehicle Model/Upgrade

4.1. You may choose from various vehicle classes subject to availability for your TS. BA Car Hire reserves the right to change the offered vehicle due to availability, but will always provide a vehicle suitable for your journey, capable of accommodating the number of passengers and luggage specified.

5. Transport Safety, Consequences, and Requirements

5.1. Luggage/Animals: The price given by BA Car Hire for TS includes the number of luggage pieces specified during booking. Excess or bulky luggage, or transportation of animals not specified, could lead to increased charges or cancellation of TS if replacement vehicles are unavailable. BA Car Hire reserves the right to refuse carriage of luggage or animals not agreed upon.

5.2. Carriage of Children: Safety seats for children must be requested during booking. You should specify the number and age of children and the required seating.

5.3. Information on Number of Guests and Pieces of Luggage: The maximum number of passengers and luggage for a specified vehicle is based on estimates. BA Car Hire may refuse carriage if safety conditions are compromised.

5.4. Prevention of Transportation Service: BA Car Hire reserves the right to cancel TS if critical requirements were not correctly communicated during booking. In such cases, BA Car Hire reserves the right to charge for the journey even if it was not undertaken.

6. Delays/Cancellations/No Shows

6.1. Delays: Delays caused by you will result in waiting time charges. Waiting time will be charged in 15-minute units.

6.2. Cancellations:

  • Transfer Services: Cancellations are free if made more than one hour before the agreed pick-up time. Cancellations within one hour of the pick-up time may incur full charges.
  • Hourly Bookings: Cancellations are free if made more than 24 hours before the agreed pick-up time. Cancellations within 24 hours may incur full charges.

6.3. Changes to Booking: Changes are treated as new bookings.

6.4. No-Shows: Failure to show within 30 minutes of the agreed time will be considered a No Show, and full charges will apply. For airport or train station pick-ups, a No Show will be deemed after 60 minutes if no communication is received.

7. Behavior in the Vehicle

BA Car Hire prioritizes the safety of its drivers and passengers. All passengers must follow the Road Traffic Act regulations and any instructions given by BA Car Hire drivers. Unsafe behavior, such as opening doors while driving, throwing objects from the vehicle, or smoking, is prohibited and may result in additional charges for cleaning and loss of business.

8. Terms of Payment

You are responsible for payment either prior to travel or upon completion of the journey. Payment conditions will be agreed upon when confirming the contract. Credit card payments can be made online or with the driver. Cash payments are only accepted in exceptional circumstances.

9. Liability

BA Car Hire is liable for any damage caused by its drivers during the provision of TS. As the contracted operator, BA Car Hire confirms that all liability rests with the company. A copy of BA Car Hire’s Public Liability insurance cover is available upon request.

10. Final Provisions

10.1. Entirety and Writing: These terms constitute the entire agreement between BA Car Hire and You for the provision of TS. Any changes or additions must be in writing and published on the BA Car Hire website.

10.2. Subject to Change: BA Car Hire reserves the right to change these terms. Notification of changes will be made by publishing the new terms on the BA Car Hire website. Continued use of services constitutes acceptance of the updated terms.
